Formation of the 51st state

Steps in the Process:
  • Declaration for the State of Jefferson by the Supervisors in the northern counties of California
  • Aggregating these Declarations and sending them to the California Legislature for action
  • Receive a positive vote from the legislature then the issue moves on to the US Congress or Receive a negative vote from the legislature then this goes directly to the courts on the basis of a lack of representation
  • If the US Congress passes the issue, Jefferson becomes a state; otherwise, the issue heads to the courts on the basis of a lack of representation where our efforts will focus on overturning Reynolds vs. Sims and a host of other court decisions that eroded the federalist system of representation
  • Provided our state formation has been successful, a constitution for the State of Jefferson will be drafted then Committees of Reconciliation will be formed to separate the assets from California to be incorporated into the State of Jefferson

How is this even possible?
  • Article IV,  Section 3 -  U.S. Constitution "New States may be admitted by the Congress into this Union; but no new State shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or Parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress."
  • Article 2, Section 1 - California Constitution "All political power is inherent in the people. Government is instituted for their protection, security, and benefit, and they have the right to alter or reform it when the public good may require."

This will not be easy; nothing worthwhile ever is.  Think of those individuals who signed the Declaration of Independence.  They knew that they were basically signing their own death warrants.  I will assume that our fates will not have such dire consequences, but will require the same amount of vigilance.
